1. Introduction

Welcome to RapWizard ("RapWizard", "we", "our", or "us"). RapWizard is an independent developer business operated by Aimee Zhang (sole proprietor). These Terms of Service ("Terms") govern your use of our website and services (collectively, the "Service") located at rapwizard.site.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Description

RapWizard is an AI rap video generation service. You upload one or more photos of a person, a pet, or a cartoon / illustration character, choose a performance style and stage, and the Service generates a short vertical video in which the subject from your photo performs an original rap — with AI-written verses and an AI-generated soundtrack featuring generated vocals.

• You must upload photos you own or are authorized to use (see Section 5)
• Videos are generated by AI models and are stylized fictional renderings, not real footage of any real performance
• All music included in generated videos is AI-generated original content produced for this Service
• Generated videos are delivered in a fixed duration and resolution determined by your chosen plan

Output is generated by artificial intelligence and may be inaccurate, imperfect, or unexpected. We do not guarantee that any generated video will resemble the uploaded photo in every detail.

AI models used. Generated videos are produced with third-party AI video generation models (which may include models developed by Kuaishou, ByteDance, and others), accessed through commercial AI generation providers. Any soundtrack included in a generated video is AI-generated as part of the generation process — it is not, and does not reproduce, any existing copyrighted recording or song.

3. User Accounts

To access certain features of our Service, you may be required to create an account. When creating an account, you must:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Promptly update your account information to keep it accurate
• Accept all risks of unauthorized access to your account
• Be at least 18 years old or the age of legal consent in your jurisdiction

You are responsible for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Acceptable Use

You agree not to use the Service to:

• Impersonate any person or entity, or otherwise mislead others about the origin or authenticity of generated content
• Violate any laws or regulations
• Infringe upon the rights of others
• Upload or transmit viruses or malicious code
• Engage in any activity that disrupts or interferes with the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service for any illegal or unauthorized purpose

In addition, the following content categories are strictly prohibited. You must not upload photos, or generate videos, that fall into any of these categories:

• Sexual or NSFW content — any sexually explicit, pornographic, or sexually suggestive material
• Violence or gore — graphic violence, blood, bodily harm, torture, or other shocking or distressing imagery
• Hate speech or harassment — content that attacks, demeans, harasses, or defames people based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic
• Child safety violations — any content that sexualizes, endangers, or inappropriately depicts minors. We have zero tolerance for this category and report it to the relevant authorities
• Non-consensual likenesses of real people (deepfakes) — videos depicting the face or likeness of a real person without their explicit consent, including celebrities and public figures, and any form of face-swapping another person's identity onto an uploaded photo
• Non-consensual intimate imagery (NCII) — any intimate, sexual, or nude imagery of a real person that is created, altered, or distributed without that person's explicit consent, including AI-generated or AI-altered sexual depictions of real people
• Intellectual property infringement — content that infringes copyrights, trademarks, or other rights, including generating videos using original songs or any copyrighted audio

5. User Content and Uploaded Photos

This Section applies to the photos and any other materials you upload to the Service ("User Content").

Ownership and authorization. You represent and warrant that you own all right, title, and interest in and to your User Content, or that you have obtained the express authorization of every person depicted in the User Content (and, where the depicted person is a minor, of their parent or legal guardian) to upload it and to have a stylized AI-generated video created from it. You must not upload photos of third parties without their authorization. The Service requires you to actively confirm this authorization each time you upload a photo.

License to us. You grant us a limited, worldwide, non-exclusive, royalty-free license to reproduce, process, adapt, and host your User Content solely as necessary to operate and provide the Service: generating your video, storing your photos and generated videos so you can access them, and delivering them to you. This license does not permit us to use your User Content or your generated videos for advertising or promotional purposes without your separate, explicit consent.

Incidental trademarks. User Content may incidentally include clothing, accessories, products, or backgrounds bearing third-party trademarks or trade dress. Such incidental appearance is not our use of those marks: we do not monitor, detect, or remove incidental trademarks in User Content, and their appearance does not constitute sponsorship or endorsement by or of any brand.

Your responsibility. You are solely responsible for your User Content and the videos generated from it. We act only as a passive conduit for your uploading; we do not pre-screen User Content. Any claim by a third party (including claims of infringement of copyright, trademark, privacy, publicity, or personality rights) arising out of your User Content or your use of generated videos is your sole responsibility.

Enforcement. We reserve the right (but not the obligation) to remove any User Content or generated video and to suspend or terminate accounts that violate these Terms, and to report suspicious uploads depicting real public figures to the extent required by law.

6. Content Moderation, Reporting, and Enforcement

Automated screening. Every upload and generation request is screened by automated content-safety systems — including those operated by our upstream generation provider — before a video is produced. Requests that appear to fall into a prohibited category (see Section 4) are refused and no video is generated; in that case the credits reserved for the generation are returned to your balance.

Reporting violations. If you believe that any content or generated video available through the Service violates these Terms — including any video that depicts you or a person you represent without consent — please report it to us at support@rapwizard.site. Include the video itself or a description of it, the relevant account or circumstances, and any other details that may help us investigate.

How we handle reports. We review every report we receive and acknowledge receipt within 72 hours. Where a report is justified, we will remove the offending content and may warn, suspend, or terminate the account responsible within 7 business days of validation. Severe or repeat violations — particularly in the zero-tolerance categories listed in Section 4 — result in permanent termination of the account. Where required by law, we will cooperate with law enforcement and other relevant authorities.

7. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of RapWizard and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Subject to your compliance with these Terms, you may download and share the videos you generate through the Service. We do not claim ownership of your User Content or of your generated videos.

8. Payment Terms; Billing Disputes

Credits are sold as one-time packs (see Pricing). By completing a purchase you expressly authorize the one-time charge for that pack. We do not offer auto-recharge or automatic renewals — nothing recurs, and there is nothing to cancel. All prices are shown at checkout before payment.

• Payments are processed by our payment processor, Waffo Pancake. Card data is handled by Waffo Pancake and never stored on our servers. Your card statement will show a descriptor referring to Waffo Pancake / RapWizard.
• Purchases are subject to Waffo Pancake's payment terms and to applicable taxes, which you are responsible for.
• Credits already used are non-refundable. Unused credits are refundable within 7 days of purchase — see our Refund Policy, which is also shown at checkout.
• If a video generation fails due to a fault of the Service, the credits reserved for that generation are automatically returned to your account.
• Credits are non-transferable, have no cash value, and never expire.

Billing disputes. If you do not recognize a charge or believe you were billed in error, contact us first at support@rapwizard.site before opening a dispute with your bank. We respond within 2 business days and aim to resolve billing issues within 5 business days, including issuing refunds where our Refund Policy applies.

9. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL RAPWIZARD, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless RapWizard and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to (a) your User Content, (b) videos you generate or share, (c) your violation of these Terms, or (d) your use of the Service.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination.

12. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, available at https://rapwizard.site/privacy. Please review it — it explains what data we collect (including your uploaded photos), how long we keep it, and your rights.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in courts located in the State of Delaware, United States.
